Policy Brief

What are the 42 Policy Briefs?

The 42 Policy Briefs are the analysis documents through which 42 Law Firm addresses current legal and regulatory issues. Each brief starts from a concrete development—a new regulation, a court ruling, or a public debate—and examines it in light of the current regulatory framework, providing practical guidance for institutions, businesses and industry professionals rather than simply offering commentary.

The topics cover the areas in which the Firm operates: artificial intelligence and emerging technologies, data protection and cybersecurity, intellectual property and copyright, compliance and corporate liability. Some briefs are co-authored with professionals and experts from outside the Firm.

The contents of the 42 Policy Briefs are intended for informational and educational purposes only and do not constitute legal advice.

The AI Act already has the brakes. It’s time to start using them.

The Policy Brief examines the relationship between AI pacing and the high-risk systems regime under the AI Act, highlighting the delay until 2027–2028 and the obligations already established to manage risks, security and human oversight.

It also identifies the key operational safeguards for providers and deployers, from risk management and technical documentation to human oversight and incident reporting, encouraging organisations to anticipate compliance with the regime.
